Terms of Service

1. Acceptance of Terms

By accessing and using the Online Vet Consultation website (https://onlinevetconsultation.com) and our services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by all of these terms, please do not use this service and discontinue use immediately.

The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.

2. Description of Service

Online Vet Consultation provides online teleadvice services for pets, which may include connecting you with veterinary professionals for consultation services. We DO NOT provide telemedicine services, and we cannot issue prescriptions, and we do not provide pet insurance.

IMPORTANT: Our pet teleadvice service is NOT a substitute for visiting a vet clinic, and will never be. If your pet has an emergency or if you are in doubt, then please visit a vet clinic immediately so that they can help your pet.

Our service includes:

20-minute video consultations via Zoom
Professional veterinary advice and guidance
Written consultation reports delivered via email
Educational resources and pet care information

3. Jurisdictional Limitations

Please note that due to legislation we are not able to provide services to customers in the following regions:

Canadian province of Ontario
Canadian province of British Columbia

This is because of legislation in the above-mentioned regions. We’re hoping that those regions will change their legislation soon so that we can provide our services to customers in those regions.

The Services are not tailored to comply with industry-specific regulations (Health Insurance Portability and Accountability Act (HIPAA), Federal Information Security Management Act (FISMA), etc.), so if your interactions would be subjected to such laws, you may not use the Services.

4. Intellectual Property Rights

4.1 Our Intellectual Property

We are the owner or the holder of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the “Content”), as well as the trademarks, service marks, and logos contained therein (the “Marks”).

Our Content and Marks are protected by copyright and trademark laws and treaties in the United States and around the world. The Content and Marks are provided in or through the Services “AS IS” for your personal, non-commercial use only.

4.2 Your Use of Our Services

Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to:

Access the Services; and
Download or print a copy of any portion of the Content to which you have properly gained access

solely for your personal, non-commercial use.

4.3 Restrictions

No part of the Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

5. User Representations

By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Services through automated or non-human means, whether through a bot, script or otherwise; (6) you will not use the Services for any illegal or unauthorized purpose; and (7) your use of the Services will not violate any applicable law or regulation.

6. User Responsibilities

6.1 Accurate Information

You agree to provide accurate, complete, and truthful information about yourself and your pet, including:

Pet’s medical history and current condition
Current symptoms or concerns
Previous treatments or medications
Your contact information

6.2 Appropriate Use

You agree to use our service only for legitimate veterinary consultation purposes and acknowledge that our teleadvice service has limitations and cannot replace in-person veterinary examinations.

6.3 Emergency Situations

You acknowledge that you are responsible for seeking immediate veterinary care for emergencies and that our service is not designed for emergency situations.

7. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:

Systematically retrieve data or other content from the Services to create or compile any collection, compilation, database, or directory without written permission from us
Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information
Circumvent, disable, or otherwise interfere with security-related features of the Services
Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services
Use any information obtained from the Services in order to harass, abuse, or harm another person
Make improper use of our support services or submit false reports of abuse or misconduct
Use the Services in a manner inconsistent with any applicable laws or regulations
Upload or transmit viruses, Trojan horses, or other harmful material
Engage in any automated use of the system, such as using scripts to send comments or messages
Attempt to impersonate another user or person
Interfere with, disrupt, or create an undue burden on the Services
Harass, annoy, intimidate, or threaten any of our employees or agents
Use the Services as part of any effort to compete with us or for any revenue-generating endeavor
Make any unauthorized use of the Services, including collecting usernames and/or email addresses of users

8. User Generated Contributions

8.1 Content You Submit

The Services may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality during which you may create, submit, post, display, transmit, publish, distribute, or broadcast content and materials to us or through the Services (“Contributions”).

8.2 Content License

By posting your Contributions to any part of the Services, you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt, and distribute such Contributions for any purpose, commercial, advertising, or otherwise.

8.3 Content Standards

When creating Contributions, you represent and warrant that:

Your Contributions are not false, inaccurate, or misleading
Your Contributions are not unsolicited or unauthorized advertising or spam
Your Contributions are not obscene, lewd, violent, harassing, libelous, slanderous, or otherwise objectionable
Your Contributions do not violate any applicable law, regulation, or rule
Your Contributions do not violate the privacy or publicity rights of any third party

9. Purchases and Payment

9.1 Payment Terms

Consultation fee: $29.95 USD per 20-minute session
Payment is required at the time of booking
We accept Visa, Mastercard, PayPal, American Express, and Discover
All payments shall be in US dollars

9.2 Payment Processing

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. Sales tax will be added to the price of purchases as deemed required by us.

10. Refund Policy

All sales and payments are final, and no refunds will be issued.

If you unexpectedly were not satisfied with the consultation, then we will offer to provide a follow-up video call with another veterinary professional for free. This call must be about the same concern that you initially reached out about.

11. Scheduling and Cancellations

11.1 Booking

Consultations must be booked in advance through our website. Availability is subject to veterinary professional schedules.

11.2 Your Cancellations

You may cancel or reschedule up to 2 hours before your appointment
Cancellations with less than 2 hours notice may forfeit the consultation fee
No-shows forfeit the full consultation fee

11.3 Our Cancellations

If we need to cancel your consultation, we will provide notice when possible and offer rescheduling or follow-up consultation options.

12. Video Consultations and Third-Party Services

12.1 Zoom Integration

Our veterinary consultations are conducted via Zoom. When you participate in a consultation, Zoom’s privacy policy and terms of service apply to the video session.

12.2 Consultation Records

Video consultations may be recorded for quality assurance, training purposes, and to maintain veterinary records. These recordings are stored securely and are only accessible to authorized personnel.

13. Service Limitations and Professional Disclaimers

13.1 Teleadvice Limitations

Our veterinary professionals cannot:

Perform physical examinations
Conduct diagnostic tests (blood work, X-rays, etc.)
Provide definitive diagnoses for complex conditions
Prescribe prescription medications
Provide treatment for conditions requiring hands-on intervention

13.2 Professional Relationship

The consultation creates a limited relationship for the purpose of providing general advice and guidance. This relationship:

Is limited to the specific consultation session
Does not establish ongoing veterinary care
Does not replace your relationship with your local veterinarian
May not meet all legal requirements in all jurisdictions

14. Privacy and Data

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by our Privacy Policy. Please be advised the Services are hosted in the United States. If you access the Services from any other region of the world with laws governing personal data collection that differ from applicable laws in the United States, then through your continued use of the Services, you are transferring your data to the United States, and you expressly consent to have your data transferred to and processed in the United States.

15. Third-Party Websites and Content

The Services may contain links to other websites (“Third-Party Websites”) as well as third-party content (“Third-Party Content”). Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy by us, and we are not responsible for any Third-Party Websites or Third-Party Content. You access third-party content at your own risk.

16. Services Management

We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Terms; (2) take appropriate legal action against anyone who violates the law or these Terms; (3) refuse, restrict access to, limit the availability of, or disable any of your Contributions; (4) remove from the Services or otherwise disable all files and content that are excessive in size or burdensome to our systems; and (5) otherwise manage the Services in a manner designed to protect our rights and property.

17. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Services without notice at any time.

We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors.

18. Disclaimers

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES’ CONTENT AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY: (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS (2) PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES
(3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS (4) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES (5) ANY BUGS, VIRUSES, OR HARMFUL CODE (6) ANY ERRORS OR OMISSIONS IN ANY CONTENT

19. Limitations of Liability

IN NO EVENT WILL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

20. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your Contributions; (2) use of the Services; (3) breach of these Terms; (4) any breach of your representations and warranties set forth in these Terms; (5) your violation of the rights of a third party, including but not limited to intellectual property rights; or (6) any harmful act toward any other user of the Services.

21. Term and Termination

These Terms shall remain in full force and effect while you use the Services. WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICES TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS.

22. Governing Law and Dispute Resolution

22.1 Governing Law

These Terms shall be governed by and defined following the laws of [Insert State/Country], without regard to conflict of law principles.

22.2 Informal Negotiations

To expedite resolution and control the cost of any dispute related to these Terms, the parties agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating formal proceedings.

22.3 Binding Arbitration

Any dispute arising out of or in connection with these Terms shall be referred to and finally resolved by binding arbitration. The arbitration shall be limited to the dispute between the parties individually. To the full extent permitted by law, no arbitration shall be joined with any other proceeding, and there is no right or authority for any dispute to be arbitrated on a class-action basis.

23. Electronic Communications

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing.

24. User Data

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services. You are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services. You agree that we shall have no liability to you for any loss or corruption of any such data.

25. Miscellaneous

These Terms and any policies posted by us on the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. We may assign any or all of our rights and obligations to others at any time. If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
